Effective January 1st' 2024, the following regulation applies to all guests booking The Vizalli Villa in Miami via www.VizalliMiami.com

Here at The Vizalli Villa, we strive to provide an exceptional experience for each and every guest. To ensure your comfort and safety, we have established a maximum occupancy limit of 8 guests per reservation. This policy allows us to maintain the quality of service and amenities you expect from a luxury accommodation. We kindly request your cooperation in adhering to all our Terms and Conditions outlined herein and to ensure that all visitors, invitees, and service personnel comply with them as well. If you have any questions or require clarification, please do not hesitate to contact our friendly team. Please note that this policy may be amended or updated periodically, and it is the responsibility of the guests to review the policy regularly to stay informed of any changes. By booking and staying at the villa, guests acknowledge and agree to comply with our Terms and Conditions.

  • Check-in after 4 pm and check-out by 11 am. Early check-in and late check-out are available at $100/hour rate based on availability.
  • Payment: A full payment must be received by the Owner with a proof of cleared funds on or before check-in. 
  • Valid identification is required to book and must match the name on the reservation at check-in.
  • All reservations allows for a maximum of 8 guests, including visitors, and any invitees at any moment during the day and/or night during the term of booking with the additional requirement that at least one guest must be older than 21 years of age.
  • Exceeding the maximum occupancy limit is not permitted and may result in additional charges and/or termination of the reservation without refund.
  • Guests are required to provide accurate information regarding the number of individuals in their group at the time of booking.
  • Any changes to the number of guests must be communicated and approved by the villa management prior to arrival.
  • Parties or events are strictly prohibited unless prior arrangements have been approved by the villa management.
  • Cancellations: Full Refund for cancellations made up to 30 days of booking.  50% refund for cancellations made within 30 to 10 days before check-in. No refund for cancelations made within 10 days before booking or no show.
  • SECURITY DEPOSIT: GUEST are required to pay the sum of $1,000.00 as security for faithful performance by GUEST of all terms, covenants and conditions.  The Vizalli Villa must return GUEST the deposit or notice, within 7 days after the end of booking term of the Owner intent to impose a claim against the deposit, collect the claim, and must return Guest the remaining deposit.
  • Guest must act, and require all other persons on the Premises to act, in a manner that does not disturb any neighbors or constitute a breach of the peace and municipal noise restrictions allowing no noise and music between 10 pm and 9 am.
  • SMOKING: Smoking is NOT permitted on the premises. See smoking policy below.
  • NO Drugs.
 

Service Personnel

To ensure the highest standards of luxury and enjoyment during your stay, we are pleased to accommodate the inclusion of a private chefs, BBQ masters, or bartender. Below are the specific guidelines regarding additional culinary staff and service personnel:

  • Guest Notification: While our properties generally accommodate up to 8 guests, we allow for the inclusion of an additional up to two (2) licensed and insured service personnel to enhance your villa experience. Please inform us in advance about the number of personnel that will be at the property, ensuring compliance with this policy.
  • Overnight Stay: Please note that service personnel are not permitted to stay overnight at the property. If they are required to stay overnight, they must be included within the maximum of 8 people allowed at the property at any time. This ensures compliance with our occupancy rules.
  • Parking Regulations: To maintain the beauty and integrity of our property and its surroundings, please ensure that no vehicles are parked on the grass and in front of neighbors’ homes. Compliance with local parking regulations is expected at all times. Please see complete Parking Guidelines below.
  • Cleanliness and Maintenance: Any service personnel must understand and agree to maintain the cleanliness and condition of the property, including kitchen-BBQ areas, or any other area of service as well as all property’s cooking appliances, tools, and equipment. It is imperative that these areas are left as clean as they were found upon your arrival. Additionally, care must be taken not to damage any surfaces during the cleaning process.
  • Compliance and Additional Fees: Adherence to this policy is essential. Failure to comply may result in additional cleaning fees, ensuring the villa remains pristine for you and future guests. We trust that these requirements will be respectfully upheld, guaranteeing the smoothness of your stay.

Parking

  •  VEHICLES: Vehicle(s) must be currently licensed, registered, operational and properly parked. Guest agrees to abide by all parking rules as follows: parking is allowed only on property’s driveway. Additional vehicles may be valet to a nearest public parking lot with respect of its rules and regulations. Trailers, campers, motorcycles, boats are NOT allowed on or about the premises without OWNER’S prior written approval. Parking on the grass and street parking are prohibited.  Street parking in front of the Property and on a back of the Property is prohibited. Vehicles not meeting the herein are unauthorized vehicles and subject to being towed at Guest’s expense. Guest agrees to indemnify Owner for any expenses incurred due to the towing of any vehicle belonging to the guest or invitee.
  • Guest(s) must insure the service personnel vehicles, including but not limited those belonging to food delivery, must adhere to all parking rules provided herein. 

Use of Property

Use of Property: Guest shall not make any alterations or modifications of the Property. Guest shall not use the premises for any illegal purpose and shall not cause a nuisance for the Owner or neighbors. Guest shall not create any environmental hazards on the premises. City’s regulations require no music or noise after 11 pm. Maximum people on a property is eight (8) at any time. The OWNER does not allow parties – no disturbance allowed by music, noise, or load voices and strictly enforced by the City. Family and friends vacations only. Filming and photography are allowed for personal use only unless is approved by the Owner. Please inquire for all commercial use. No adult movies allowed.

ASSIGNMENTS: Guest shall not assign this agreement or sublet the premises or any part thereof. Any unauthorized transfer of interest by the Guest shall be a breach of this agreement and its Terms and Conditions.

Default

DEFAULT: Guest’s violation of any term, condition or covenant of this terms and condition, rules and restrictions, failure of Guest to comply with any federal, state and/or local laws, rules and ordinances, or Guest’s failure to check-in into the premises or Guest’s abandonment of the premises before the end of term, failure to check-out at the end of term, shall constitute a default by Guest. Upon default, Guest shall owe Owner all sums under the terms of this agreement, the stay is interrupted by immediate booking cancellation, Owner retakes possession of the premises and Guest is required to immediately vacate the property without a refund.

RIGHT OF ENTRY: The Owner or Owner’s assignee may enter the property in case of emergency and/or Guest’s default and breach of terms and conditions of this agreement.

Vacating

VACATING: At the expiration of this agreement or any extension, Guest shall surrender the premises and turn in all keys and any other property owned by Owner leaving the premises in good and sanitary condition. The premises shall be left in the same condition as delivered to Guest at the beginning of this agreement with the exception of normal use of linens. If additional deep cleaning is required at the end of the lease term, the cost will be deducted from the security deposit. In the event all keys are not returned upon check-out, there will be a minimum charge to be deducted from the security deposit in the amount of Market Rate.

Indemnification

INDEMNIFICATION: Guest agrees to reimburse Owner upon demand in the amount of the loss, property damage, or cost of repairs or service (including but not limited to plumbing trouble) caused by the negligence or improper use by Guest, his invitees, family, guests or any other individuals directly or indirectly involved with Guest. Guest at all times, will indemnify and hold harmless the Owner from all losses, damages, liabilities and expenses which can be claimed against Owner for any injuries or damages to the person or property of any persons, caused by the acts, omissions, or neglect or fault of Guest, his AGENTS, family, guests, or any other individuals directly or indirectly involved with Guest.

Safety

SAFETY OF PERSON/PROPERTY: Guest acknowledges that certain conditions may exist in or about the subject property that may create a risk of personal injury or property damage.  Some examples may include steps, uneven surfaces, pool/hot tub/jacuzzi and other body of water that does not have a protective barrier, gate, or lock, cabinets and electrical outlets that are not child-proof, window treatment, cords, or elevated surfaces. Guest acknowledges that it is GUEST’S sole responsibility to identify any such conditions and take proper safety and protective measures to protect Guest, its children, family members, friends, and Guest’s invitees and their property from loss or injury. Guest agrees to defend, indemnify and hold harmless the Owner from any claims or losses (including personal injury) by Guest, its children, family members, friends or Guest’s invitees in any way arising out of or relating to these or any similar type conditions.

Safety devices on the property: smoke alarm, exterior video cameras, carbon monoxide alarm/detectors.

Personal Property Liability

RISK OF LOSS: All guests’ and their invitees’ personal property shall be at the risk of the Guest, and Owner shall not be liable for any damage to said personal property, including any vehicles, arising from criminal acts, fire, storm, flood, rain or wind damage, acts of negligence of any person whomsoever, or from any incident at the property. Owner shall not be responsible for the loss of any personal property, or food in the event of any defect of appliances or any other electrical failure.

  • Reporting Incidents: In the event of the incident of theft or damage is reported to the local authorities. The management and the Owner will provide reasonable assistance in facilitating communication with local law enforcement but is not responsible for the outcome of any such reports.

Personal Liability

  • Acknowledgment and Acceptance of Risks: By agreeing to rent a villa through www.Vizallimiami.com, you acknowledge that there are certain inherent risks associated with the property that could result in physical injury or other damages. These risks include, but are not limited to, uneven surfaces, steps, the presence of a swimming pool and other body of water, elements such as rocks around the pool, branches, encounters with local wildlife, and the natural environment which can include a fallen coconuts and branches, other natural elements.
  • No Liability for Injuries: The Owner shall not be liable for any personal injuries sustained by guests, guest’s invites, pets, and any service personnel during your stay at the villa. This includes injuries resulting from any activities on the property, whether they involve the use of electrical outlets, appliances, barbecue grills, pool, interactions with wild animals, etc 
  • Guests are advised to exercise caution and respect the natural habitat of local wildlife.
  • Personal Liability for Guests’ Pets: Guests bringing pets onto the property are solely responsible for the behavior and actions of their pets. The Owner shall not be liable for any damages or injuries caused to guests’ pets and by guest’s pets to other guests, service personnel, neighboring property owners or any public. Guests are responsible for ensuring their pets are kept under control at all times, being vaccinated, insured, and are properly restrained as necessary.
  • Natural Disasters: The Owner is not responsible for any injuries, damages, or losses due to natural disasters including but not limited to hurricanes, earthquakes, floods, or any other acts of nature. We advise all guests to adhere to local weather advisories and take necessary precautions during their stay.
  • Use of Facilities: All facilities such as the swimming pool, barbecue, kitchen appliances, etc. are to be used at your own risk. The Owner is not be liable for any accidents or injuries resulting from the use of any facilities on a property.
  • Insurance: We highly recommend that all guests purchase comprehensive travel insurance to cover any unexpected personal injuries, accidents, or losses during their stay at the villa, including those involving guests’ invites, and pets.
  • Compliance with Rules and Regulations: Guests are required to comply with all rules and regulations provided herein upon arrival and throughout their stay at the villa. Failure to adhere to these rules and guidelines may increase the risk of injury and, as such, shall be the sole responsibility of the guest.
  • Indemnification. By accepting the terms of this Terms and Conditions, you agree to indemnify and hold harmless the Owner and The Vizalli Villa, its owners, employees, and agents from any claims, lawsuits, damages, losses, costs, and expenses relating to or arising out of any injuries or damages sustained during your stay, including those caused by guests’ pets.

Agreement to Terms and Conditions: By finalizing your booking, you acknowledge that you have read, understood, and agree to the terms outlined in this Terms and Conditions agreement.  

This Terms and Conditions agreement is governed by the laws of the State of Florida, applicable to contracts to be wholly negotiated and performed in Miami Dade County. Any claim, dispute or disagreement with respect to this agreement will be submitted to the state or federal courts within the Miami Dade County in the State of Florida, which courts will have exclusive jurisdiction, and the parties consent to jurisdiction in those courts. In the event it becomes necessary to enforce this Agreement concerning enforcement of the Terms and Conditions of this Agreement through the services of an attorney, Guest shall be required to pay Owner’s reasonable attorney’s fees and court costs. Guest and Owner waive the right to demand a jury trial concerning any litigation between Guest and Owner regarding enforcement of the terms and conditions of this agreement.
